General Terms and Conditions (GTC)

In case of discrepancies, the German version shall prevail for contracts governed by German law.

§ 1 Scope of Application

(1) These General Terms and Conditions apply to all contracts between

(hereinafter “Provider”)

and its clients (hereinafter “Client”) regarding coaching, consulting, training, workshops, group programs, events, and digital services.

(2) Consumers within the meaning of § 13 German Civil Code (BGB) are natural persons acting for purposes outside their trade or profession.
Entrepreneurs within the meaning of § 14 BGB are natural or legal persons acting in a commercial capacity.

(3) Deviating terms of the Client shall not apply unless expressly agreed in writing.

§ 2 Services

(1) The Provider offers coaching, consulting, training, and educational services for expats, their partners, and companies.

(2) Services may include:

  • One-to-one coaching (online or on-site)

  • Group programs

  • Workshops

  • Networking formats

  • Corporate trainings

  • Digital courses and online content

(3) The specific scope and content result from the service description or booking confirmation.

(4) The Provider does not guarantee any specific economic, professional, or personal success. Implementation of content remains the responsibility of the Client.

§ 3 Conclusion of Contract

(1) Service descriptions on the website or social media do not constitute binding offers.

(2) A contract is concluded through:

  • Online booking

  • Acceptance of an individual offer

  • Written confirmation by email

(3) By booking, the Client accepts these GTC.

§ 4 Prices and Payment

(1) All prices are stated in euros plus statutory VAT.

(2) Payment is due upon conclusion of contract or according to invoice.

(3) Payment plans may be agreed for programs or corporate services.

(4) The Provider may request advance payments.

(5) Statutory default provisions apply in case of late payment.

§ 5 Right of Withdrawal (Consumers)

(1) Consumers are entitled to a statutory right of withdrawal.
Details are set out in the separate Withdrawal Policy.

(2) For digital content and services, the right of withdrawal expires prematurely if:

  • the Client expressly agrees that performance shall begin before expiry of the withdrawal period, and

  • the Client confirms knowledge that the right of withdrawal is thereby lost.

§ 6 Cancellations

6.1 One-to-One Coaching

  • Free cancellation up to 48 hours before the appointment.

  • Full fee payable thereafter or in case of no-show.

6.2 Group Programs, Workshops, Events

  • Free cancellation up to 14 days before start.

  • 50% fee up to 7 days before start.

  • 100% fee from 7 days before start or in case of no-show.

  • Substitute participant allowed with prior approval.

6.3 Digital Courses

(1) For digital courses with immediate access, performance begins immediately after purchase.

(2) The right of withdrawal expires in accordance with § 5 if required consent has been given.

(3) No refund is granted once full access to digital content has been provided.

§ 7 Cancellation by Provider

(1) The Provider may cancel or postpone services for good cause (e.g. illness, force majeure, insufficient participants).

(2) Fees paid will be refunded or credited.

(3) No further claims arise.

§ 8 Client Responsibilities

(1) Clients are responsible for their physical and mental health.

(2) Coaching does not replace medical, psychotherapeutic, or legal advice.

(3) Respectful conduct is required in group settings.

§ 9 Liability

(1) The Provider is fully liable for intent and gross negligence.

(2) In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damages.

(3) Liability for injury to life, body, or health remains unaffected.

(4) Liability under the German Product Liability Act remains unaffected.

(5) Liability for indirect damages, including loss of profit, is excluded insofar as legally permissible.

§ 10 Copyright

All materials provided are protected by copyright and may only be used for personal or internal business purposes.

§ 11 Confidentiality

Both parties agree to treat confidential information as confidential.

§ 12 Data Protection

Personal data is processed in accordance with applicable data protection laws.
Details are provided in the Privacy Policy.

§ 13 Applicable Law and Jurisdiction

(1) German law applies.

(2) For contracts with entrepreneurs, place of jurisdiction is Mainz, Germany.

(3) For consumers, statutory jurisdiction rules apply.

§ 14 Special Provisions for Entrepreneurs (B2B)

  • Individual agreements may prevail.

  • Payment term: 14 days from invoice date.

  • No specific business success is owed.

  • Client ensures organizational readiness.

§ 15 Events

  • Participation requires full payment.

  • No refund in case of no-show.

  • Format adjustments permitted if overall character is maintained.

  • Participants may be excluded in case of disruption.

§ 16 Severability Clause

If individual provisions are invalid, statutory provisions shall replace them. The remainder remains unaffected.

§ 1 Geltungsbereich

und ihren Kunden über Coaching-, Beratungs-, Trainings-, Workshop-, Event- sowie digitale Leistungen.

Verbraucher im Sinne des § 13 BGB sind natürliche Personen, die ein Rechtsgeschäft zu privaten Zwecken abschließen.
Unternehmer im Sinne des § 14 BGB handeln in Ausübung ihrer gewerblichen oder selbstständigen Tätigkeit.

Abweichende Bedingungen werden nicht Vertragsbestandteil.

§ 2 Leistungen

Die Anbieterin erbringt Coaching-, Beratungs- und Weiterbildungsleistungen für Expats und Unternehmen.

Der konkrete Leistungsumfang ergibt sich aus der jeweiligen Leistungsbeschreibung.

Ein bestimmter wirtschaftlicher oder persönlicher Erfolg wird nicht geschuldet.

§ 3 Vertragsschluss

Ein Vertrag kommt durch Online-Buchung, Annahme eines Angebots oder schriftliche Bestätigung zustande.

§ 4 Preise und Zahlung

Alle Preise verstehen sich zuzüglich gesetzlicher Umsatzsteuer.

Die Vergütung ist mit Vertragsschluss oder gemäß Rechnung fällig.

Vorauszahlungen können verlangt werden.

§ 5 Widerrufsrecht

Verbrauchern steht ein gesetzliches Widerrufsrecht zu.

Bei digitalen Inhalten oder Dienstleistungen erlischt das Widerrufsrecht vorzeitig, wenn:

  • der Kunde ausdrücklich zustimmt, dass vor Ablauf der Frist begonnen wird,

  • und er bestätigt, dass er sein Widerrufsrecht dadurch verliert.

§ 6 Stornierung

1:1 Coaching:
Kostenfrei bis 48 Stunden vorher, danach volles Honorar.

Gruppenprogramme/Events:
14 Tage kostenfrei, danach gestaffelte Gebühren (50% / 100%).

Digitale Kurse:
Bei sofortigem Zugang erlischt das Widerrufsrecht gemäß § 5.

§ 7 Absage durch Anbieterin

Bei wichtigem Grund erfolgt Erstattung oder Umbuchung.

§ 8 Mitwirkungspflichten

Coaching ersetzt keine medizinische oder therapeutische Behandlung.
Respektvolles Verhalten ist verpflichtend.

§ 9 Haftung

Unbeschränkte Haftung bei Vorsatz und grober Fahrlässigkeit.

Bei leichter Fahrlässigkeit nur bei Verletzung wesentlicher Vertragspflichten.

Haftung für Leben, Körper, Gesundheit bleibt unberührt.

Produkthaftung bleibt unberührt.

§ 10 Urheberrecht

Alle Inhalte sind urheberrechtlich geschützt.

§ 11 Datenschutz

Es gilt die Datenschutzerklärung.

§ 12 Gerichtsstand

Für Unternehmer ist Gerichtsstand Mainz.
Für Verbraucher gelten gesetzliche Regelungen.

§ 13 Salvatorische Klausel

Unwirksame Bestimmungen werden durch gesetzliche Vorschriften ersetzt.
